These Terms and Conditions ("Terms") govern your use of the website at masonrybellingham.com and your engagement with the contracting services provided by Bellingham Masonry & Concrete ("we," "us," or "our"), a masonry contractor based in Bellingham, WA. By using our website or entering into a service agreement with us, you agree to these Terms. If you do not agree, please do not use our website or engage our services.
By accessing or using this website, submitting a contact form, or signing a written estimate or contract with Bellingham Masonry & Concrete, you agree to be bound by these Terms. We reserve the right to update these Terms at any time by posting the revised version on this page with an updated effective date. Your continued use of the website or our services after any change constitutes acceptance of the revised Terms.
Bellingham Masonry & Concrete provides residential and commercial masonry contracting services in Bellingham, WA and surrounding Whatcom County communities. Services include but are not limited to foundation repair, chimney repair, tuckpointing, brick and stone work, retaining walls, driveway pavers, walkway construction, fireplace installation, and masonry restoration. The specific scope of any project is defined by a written estimate or contract agreed to by both parties before work begins. We reserve the right to decline any project at our discretion.
Estimates provided by Bellingham Masonry & Concrete are based on a visual inspection of the site and the information available at the time of the estimate. An estimate is not a final binding quote unless both parties have signed a written contract. Actual costs may change if conditions discovered during the work differ materially from those visible at the time of the estimate - for example, if water damage, structural issues, or concealed material failures are found once work begins.
In the event of any required scope change, we will notify you in writing or verbally before proceeding with additional work, and we will obtain your approval before incurring additional costs above the original estimate.
Scheduling is subject to crew availability and weather conditions. Masonry work - particularly mortar, concrete, and sealant applications - may need to be rescheduled if weather conditions are unsuitable. We will notify you as soon as possible if a scheduled date must change.
If you need to cancel or postpone a scheduled project, we request at least 48 hours advance notice. Cancellations made after work has begun, or after materials have been purchased specifically for your project, may be subject to costs for materials and labor already expended, as outlined in your written contract.
Payment terms are established in your written contract. A deposit may be required before work begins, particularly on larger projects requiring significant material purchases. Final payment is due upon satisfactory completion of the work, unless otherwise specified in writing.
Balances not paid within the timeframe specified in your contract may be subject to a late fee as described therein. We reserve the right to suspend or discontinue work on any project with an outstanding unpaid balance after providing reasonable notice.
Where a written warranty is provided for completed work, its terms are as stated in that document. Warranties apply only to defects in materials or workmanship arising from the specific scope of work performed by Bellingham Masonry & Concrete.
Warranties do not cover damage caused by events outside of our control, including but not limited to: acts of nature, seismic events, flooding, freeze-thaw cycles beyond normal seasonal conditions, soil movement or settling, impacts from vehicles or equipment, or alterations made to the completed work by any party other than Bellingham Masonry & Concrete.
The website and any information provided on it are offered "as is." We make no warranties, express or implied, regarding the accuracy or completeness of website content, and such content should not substitute for an in-person professional assessment of your specific situation.
To the fullest extent permitted by law, Bellingham Masonry & Concrete shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to our services or your use of this website, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from our services shall not exceed the amount you paid us for the specific work giving rise to the claim. Some states do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
By scheduling work with Bellingham Masonry & Concrete, you represent that you have the legal authority to authorize work on the property and that you will provide reasonable access to the work area as needed. You agree to disclose any known hazards on the property, including buried utilities, asbestos, or structural concerns not visible during the estimate. We are not responsible for damage to underground utilities or other concealed conditions that were not disclosed prior to work beginning.
If a dispute arises between you and Bellingham Masonry & Concrete relating to our services or these Terms, we ask that you first contact us directly so we can attempt to resolve the matter in good faith. Most concerns can be addressed quickly with a direct conversation.
If the matter cannot be resolved through direct communication, disputes shall be resolved through binding arbitration in Whatcom County, WA, under the rules of a mutually agreed arbitration service, unless prohibited by applicable law. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Bellingham Masonry & Concrete.
These Terms are governed by and construed in accordance with the laws of the State of Washington, without regard to conflict of law principles. Any legal action not subject to arbitration under Section 9 shall be brought in the state or federal courts located in Whatcom County, Washington.
You agree to use this website only for lawful purposes. You may not use our website to transmit any material that is harmful, threatening, abusive, or that infringes on any intellectual property or other rights. We reserve the right to restrict or terminate access to the website at any time without notice.
